§ 110.06. FEE IMPOSED.

  • (A) Levy and imposition. For the purpose of providing funds for the general operating expenses of the city and the municipal services and functions provided thereby, and subject to the provisions of KRS 67.750 through 67.795, and except as provided in § 110.05 of this chapter, an occupational license fee is hereby levied and imposed upon everybody engaged in any franchise, trade, occupation, profession or other businesses in the city, for the privilege of that engagement.
    (B) Rate.
    (1) The occupational license fee that is levied and imposed by this chapter is at the rate of one and fifteen one-hundredths percent (1.15%) of the gross annual salaries, wages or compensations earned by any such person for work done or services performed or rendered within the city beginning the first day of January, 2019.
    (2) Payroll taxes levied on wages, earning, bonuses, and money paid to employees by an employer or a self employer shall be limited to the maximum amount on which social security taxes are paid by one employer or employee.
    (C) Employees. One and fifteen one-hundredths percent (1.15%) of all of the gross compensation earned by an employee for labor, work or services provided in the city.
    (D) Those not an employee.
    (1) Seventy-five hundredths percent (0.75%) of the net profits of everybody, other than an employee, who is engaged in any franchise, trade, occupation, profession or other business in the city; but no less than fifty dollars ($50) provided, however, that the Mayor or City Administrative Officer may waive the fifty dollar ($50) minimum in the event of either:
    (a) The total gross receipts from activities in the city during the tax period are less than five thousand dollars ($5,000): or
    (b) Within 30 days after the close of the tax year of the taxpayer, the city receives a written request for a refund of the balance of the fifty dollar ($50) minimum that has been paid after deducting the tax that is due based on a rate of seventy-five hundredths percent (0.75%) of the net profits generated in the city.
    (2) There is hereby reserved to the Mayor or the City Administrative Officer the right to deny any request for a waiver of the fifty dollar ($50) minimum that is incomplete or fails to follow the process for that waiver described in this section.
    (E) Administrative provisions. The provisions of this chapter shall be administered and enforced by the City Administrative Officer, who is hereby authorized to promulgate any additional regulations in regard thereto which are not inconsistent with any state statute, or any ordinance of the city, or any executive order of the Mayor.
    (F) Purpose of occupational license fee. The purpose of the business regulatory license fees and the occupational license fees imposed and levied by this chapter is to fund the general operating expenses of the city, including, without limitation, police, fire, emergency medical, public works and administrative services.
